1. Acceptance

By using Performance Home Solutions services (the “Service”), including the Flooring Leadline product line, you agree to these Terms of Service. If you do not agree, please do not use the Service.

2. The Service

The Service provides AI-powered call answering, scheduling, and website features for home-services contractors. We may add, change, or remove features at any time.

3. Subscriptions and Billing

Paid plans are billed monthly in advance through our payment processor. Setup fees are charged once at signup. You may cancel at any time; cancellation takes effect at the end of the current billing period and does not entitle you to a refund of fees already paid.

4. Acceptable Use

You agree not to use the Service for unlawful, deceptive, or fraudulent purposes; to send unsolicited marketing messages; or to impersonate another business. We may suspend or terminate accounts that violate these rules.

5. Customer Data

You retain ownership of customer information collected through the Service. We process it on your behalf as a service provider, in accordance with our Privacy Policy.

6. Disclaimers

The Service is provided “as is” without warranty of any kind. AI-generated responses may occasionally be incorrect or incomplete. You are responsible for reviewing scheduled appointments, captured leads, and outbound communications before relying on them for material business decisions.

7. Limitation of Liability

To the fullest extent permitted by law, Performance Home Solutions will not be liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data, arising out of or in connection with the Service. Our aggregate liability shall not exceed the fees you paid us in the twelve months preceding the claim.

8. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email to the account on file at least 14 days before they take effect.
